1.      Facts of the case:


In conjunction with a 1995 Trade Mission to India sponsored by the then Governor of Massachusetts, William Weld, a memorandum of understanding was signed by Consortium members, Indian officials, including then Karnataka Chief Minister, H.D.Deve Gowda, and U.S. officials, which set the stage for launching the Bangalore Mysore Infrastructure Corridor project. The Consortium, Nandi Infrastructure Corridor Enterprises (NICE), comprises the Kalyani Group of Companies, VHB International LTD. and SAB International LTD. to develop the Bangalore Mysore Infrastructure Corridor.


The project has been in controversy since the day of planning. In October 2012, the Karnataka Lokayukta ordered a probe into several former chief ministers in matters relating to irregularities in land acquisition for the project.[4]


It is planned to go through Mysuru, Srirangapattana,  Pandavapura, Mandya, Maddur,  Channapattana,  Ramanagara, Kengeri and Bengaluru.


The Nandi Infrastructure Corridor Enterprises Road, commonly known as NICE Road and officially called Bengaluru–Mysuru Infrastructure Corridor (BMIC), is a proposed 4 to 6 lane private tolled expressway that intends to connect the two important cities  Bengaluru  and Mysuru in the Indian state of Karnataka. This is being constructed by Nandi Infrastructure Corridor Enterprises (NICE) chaired by Ashok Kheny on a Build-Own-Operate-Transfer (BOOT) basis.


       NICE  has  violated many guidelines of the project agreement  and is not in a legal position  to collect toll.  The illegalities by NICE  are upheld by Karnataka Lokayukta , Karnataka Legislature Committee. Still  the Government of Karnataka  has not referred the case to CBI and NICE company is  illegally collecting  hundreds of crores of rupees toll , etc year on year. Successive Chief Ministers of Karnataka  since 1995 are  guilty of aiding  criminal acts of NICE.

3. Grounds:

Requests for equitable justice. Prosecution of  corrupt  ministers    &  Corrupt  Public  Servants.


4. Averment:


Hereby , I do request the honorable supreme court of India to consider this as a PIL for : “writ of Mandamus” and to issue instructions to the concerned public servants in the  cases to perform their duties.



PRAYER:

In the above premises, it is prayed that this Hon'ble Court may be pleased:


 a . Hereby , I do request the honorable supreme court of India to consider this as a PIL for : “writ of Mandamus” and to issue instructions to the concerned public servants , in the case to perform their duties.


b. To register FIR  against  CEO  of  NICE  for  cheating Government of Karnataka.


c. To constitute an impartial  investigation team to investigate the crimes  by NICE  & illegal support extended to it by powers that be. The team must be accountable to the public.


d. to protect the  human rights , constitutional rights of advocates , petitioners who are seeking truth in the above cases.


e. to  order  NICE to give  compensation amount at market value to land lossers with penal interest.


f.to order  Government of Karnataka  to  take back excess land  illegally acquired by NICE than the original  project plan  and give it back to original land owners with penalty to be paid by NICE.


g. to initiate criminal legal prosecution against  cabinet ministers , public servants  who repeatedly  gave gross deviations  ( from original project plan ) to NICE  benefitting the promoters.


h. if the supreme court of india  further delays in  taking action , in stopping loot of poor farmers  , in stopping  cheating  of  Government of Karnataka ,  the presiding judges of Supreme Court of India will be indirectly aiding the criminals. In such a case , such  Judges will also become part of  criminal nexus and stands to be criminally prosecuted.


i . to pass such other orders and further orders as may be deemed necessary on the facts and in the circumstances of the case at the earliest.

₹7000 crore NICE scandal set to explode in Karnataka



The committee has suggested the case be handed over to the CBI or the Directorate of Enforcement, since many VVIPs, politicians, foreign investors and entrepreneurs are involved.  

The Karnataka Legislative Committee is all set to submit a possible ₹7000 crore bombshell before the state legislative assembly, now that it has finished its investigation into the Bengaluru peripheral ring road project of Nandi Infrastructure Corridor Enterprises (NICE). The road, commonly called the NICE road, is part of the larger Bangalore Mysore Infrastructure Corridor.


The House committee, headed by Law Minister TB Jayachandra, was formed two years ago to probe allegations of gross irregularities during the construction of the NICE road on the outskirts of the city. The committee is going to submit its final report to the government next week.


During the investigation, the committee discovered that around 135 important files, with regards to NICE activities, are missing and more than 30 top officials and politicians are involved in the scandal.


Besides the illegalities in the road construction, NICE had acquired around 553 additional agricultural plots for the construction of townships. In the acquired land, NICE has constructed hundreds of flats and sold them at its own discretion, without any permission from the BDA or the BBMP - Bengaluru's municipal authorities.


The committee has suggested that the government hand over the case to the CBI or the Directorate of Enforcement, since many VVIPs, politicians, foreign investors and entrepreneurs are involved in what appears to be a giant scam.   


Here are the main points of the report:

·         Why was an additional 2813 acres of farmland allotted to NICE for its ring road project?

·         NICE has carried out illegal quarry work in the land allotted for road construction.

·         By this illegal quarry work, NICE has unearthed 1.75 metric tons of stones.

·         Out of a total 14000 acres allotted to NICE, stamp duty was waived off for 5900 acres.

·         Around 135 files and confidential documents with regard to NICE' activities have disappeared.

·         More than 30 top officers are involved in the NICE illegalities.

·         NICE was allotted 553 additional farmland in the name of township construction.

·         Instead, apartments were constructed in the land allotted for the construction of the township and sold to private parties.

·         It is estimated that NICE made an illegal profit to the tune of ₹ 7000 crore.

Suggestions given by the committee:

·         Confiscate the toll charges collected since 2012.

·         Collect royalty of ₹300 crore for conducting illegal quarry work.

·         Further investigation to be handed over to the CBI or the Directorate of Enforcement.

·         Cancel the Bangalore Mysore Infrastructure Corridor Area Planning Authority (BMICP), which allotted the Bangalore-Mysore Infrastructure Corridor to NICE.

·         Government should acquire all the additional lands that were allotted to NICE.


Supervisory panel to implement report on NICE road project


The state government has decided to constitute a supervisory committee to implement the Legislature Committee Report on Bangalore-Mysore Infrastructure Corridor (BMIC) project being carried out by Nandi Infrastructure Corridor Enterprise (NICE).



The committee has recommended a probe by the Central Bureau of Investigation (CBI) or the Enforcement Directorate into the alleged irregularities by NICE.



The committee stated, “Considering the current status of the project, amendments and modifications to the project profile and irregularities in framework of agreement management, there is an urgent need to institute an enquiry fixing accountability and also for taking remedial measures.” The 391-page report was tabled in the House during the recent Belagavi session of the state legislature. The 11-member committee was headed by Law and Parliamentary Affairs Minister T B Jayachandra. 


The committee has found violations of 24 out of 30 guidelines laid down in the original framework of the agreement entered between the state government and NICE.

Based on the survey, the House committee recommended dropping of 1,160 acres of both private and government land from the project. It also said land meant for inter change connectivity has been misused by the company, thereby earning an illegal revenue of `4,956 crore.




ILLEGALITIES IN BANGALORE-MYSORE EXPRESSWAY PROJECT BMIC by NICE



Different political parties are trading charges against each other about illegalities in the mysore-bangalore expressway project. Grave mistakes have been committed by the previous state governments. The saving grace is judiciary has taken note of it. The fundamental principle behind land acquisitions by the governments is to use that acquired lands for public welfare. As the govt acquires the land with this noble intentions even the land looser contents himself with compensation at govt rate. 


Always the govt rate is much below market value. If at all the govt wants to give out that acquired land to a private party for private use or for the use of a selected few, the govt must give prevailing market rate to the land looser. In such cases the govt does not have authority to force the land owner to sell his property.


In this mysore-bangalore 4 lane expressway project, following inconsistencies are there,


1.   this road is not for free public use, but only for those who pays the toll fees.


2.   The luxurious resorts , townships , etc which are to be built alongside this road are not open for free public usage but only for the rich who can afford it.


3.   The govt has concluded this deal in a hush-hush manner.


4.   Any disputes raised by this project should be addressed to international arbiter at london which a poor land owner or general public can ill-afford.


5.   The govt has not paid the prevailing market value to the land loosers.


6.   The govt has not given the option to land owners not to sell their property.


7.      This whole project is for rich , built by the rich for the rich & not meant for public welfare.


The govt must give back the lands to the owners who wants it back & must pay the market value to those willing to sell. As this project is built by wealthy people for wealthy people why cann't they cough- up market value?

When a crime is noticed , it is the duty of the government to investigate who did it ? and to legally prosecute them in court & provide justice . if  thousands of criminals , lakhs of criminals  got together & did the same type of crimes , all of them must be legally prosecuted. Just  for the overwhelming numbers of criminals law of the land cann't be changed. However  in the Karnataka state , many political bigwigs , rich crooks have done the same crime , LAND GRABBING – illegal possession of government land & illegal constructions over it. Important land records of those government lands , lands belonging to poor are lost in record rooms of civic bodies ( cunningly destroyed by corrupt officials ) Now, their political masters are legalizing the crimes . what a shame to the government of Karnataka ?


The  shri.A.T. RAMA SWAMY , (M.L.A) standing committee in the Previous legislative assembly probed  the land grabbings in Karnataka & gave it's report to the government . However the government in a hurry , is auctioning – off  those government lands without proper publicity  to the auction process , sufficient time for bidder's expression of interest. In some cases , a pittance is levied as penalty for the illegal occupation to get it legalized. The government is not bothered about legally prosecuting the illegal  occupier  of those lands. In many civic bodies , important property documents belonging to the government  & poor are missing from the record rooms. All these point towards the government intention , to legalise the crimes of  illegal land occupiers who are nothing but their own political  cronies.


The recent ordinance by government of Karnataka to regularize land deals is envisaging to legalize the crimes of rich. The illegal land conversions , land encroachments , encroachment of civic amenities made by the rich are being legalized with levying a pittance as penalty in the name of public welfare . Whereas the land worth at today's market prices are 10's of thousands of crore it is only wefare of the rich & mighty .


 IT IS GOING TO BE MOTHER OF ALL SCAMS.  


The authorities evict poor tribal people from their ancestral forest area in the name of conservation , evict tribal people from villages in the name of development without proper rehabilitation measures. The government is not giving land rights to slum dwellers , poor , dalits over the land they are dwelling , the government is deaf to appeals of dalits for land rights. However the same government is sympathetic to rich who have encroached land & built huge commercial complexes worth crores violating all norms with total disregard to civic amenity or safety.

BMIC Project, a monumental fraud

The House Committee of the Karnataka Legislature has done a commendable job in exposing the monumental fraud in the execution of the Bangalore-Mysore Infrastructure Corridor Project, which is nowhere near completion even two decades after it was sanctioned. The committee, headed by Law Minister T B Jayachandra, has pointed out that the promoter of the project, the Nandi Infrastructure Corridor Enterprise (NICE), had violated 16 of the 22 agreement norms and yet no action had been initiated. Though the objective of the project was to build 111 km concrete expressway between Bengaluru and Mysuru, besides five townships, it has not progressed beyond Bengaluru city. Pointing out that NICE has “illegally” collected Rs 1,350 crore as toll from road users since 2012, the committee has recommended stopping the toll and forfeiture of the fee collected so far.



The contours of this scandal, which ‘passed’ through at least five different governments headed by all major political parties in Karnataka, are mind-boggling. From grossly excess land being allotted at a throwaway price of Rs 10 per acre, to sale deeds being issued for lands meant to be given on lease, to illegally allotting 20 lakes extending over 213 acres for the construction of the road, the political and administrative patronage the project received was extraordinary. It appears that Ashok Kheny, managing director of NICE and currently an independent MLA, could get anything done at will as the stamp duty exemption initially

given for 5,688 acres was extended to 14,337 acres, causing huge financial loss to the government, and he was allowed to freely sell and mortgage hundreds of acres of land in violation of the clauses of the original framework agreement. The land owners or farmers have been the real victims of the project as only 27% of them have received full compensation, and a field study conducted by the Institute for Social and Economic Change found that, shockingly, nearly 60% of the land losers have become daily wage

earners. The fact that as many as 137 important files concerning the project have mysteriously gone missing and a former PWD secretary, who represented the government in the initial stages of the project, has joined NICE as a director, speaks volumes

of the complicity of the official machinery in the fraud.



As rightly suggested by the committee, it is a fit case to be handed over to the CBI and the Enforcement Directorate for further investigation into the irregularities and stringent penal action to be taken against all those involved. The state government should also initiate immediate action to withdraw 11,660 acres of excess land earmarked for the project and make out a strong case for taking over the project in the larger public interest.




A NICE fraud?

An environmental group in Bangalore discovers that the project consortium given the contract for Bangalore Mysore Infrastructure Corridor project, never existed in theory. Subramaniam Vincent reports from Bangalore. 



The contract for one of the largest transportation related infrastructure development schemes initiated in India in recent times, the Bangalore Mysore Infrastructure Corridor, [BMIC], has been awarded by the Government of Karnataka, to a consortium that even in theory, never existed. What's more, this is a project that has been heralded as a "model" for India in the era of that benevolent tide that promises to lift all boats, Globalisation. The Economic Times, April 27, 2001, even carries a story on how this freeway project is going to bring the US look and feel to India, reporting that BMIC is based on a Maryland success story.



“VHB is not and never has been a principal in Nandi Infrastructure Corridor Enterprise (NICE). VHB was engaged by NICE to prepare a preliminary plan for the BMIC. This plan was completed in 1995. Since then VHB has not been involved.”, wrote Richard Hangen, Senior Vice President of the US based Vanasse Hangen Brustlin (VHB, rhangen@vhb.com), in response to a query from Leo Saldanha, Coordinator of the Environment Support Group. “I do not know of the existence of any scope defining a future role for us”, he further adds, in a different letter.



That then, is how the Senior Vice President of the US based Vanasse Hangen Brustlin (VHB, www.vhb.com) has very recently characterised the role for his company in the controversial Bangalore Mysore Infrastructure Corridor (BMIC). Nandi Infrastructure Corridor Enterprise Ltd (NICE) is the company formed to develop the controversial BMIC project. Between 27 March and 3rd April 2001, various query letters were sent by Leo F. Saldanha, Coordinator of Environment Support Group via email to Mr.Richard Hangen.


So what is the story in this neck of the woods, Bangalore? Contrary to Mr. Hangen’s assertions, NICE claims that VHB is a part of the Project Consortium. In its entire official project documentation NICE repeatedly affirms the integral involvement of VHB in the project and in its official website (http://business.vsnl.com/niceltd/) claims for VHB a role and capacity as “the Consortium’s lead engineer for the Bangalore Mysore Infrastructure Corridor Project”. Clearly, this is contradictory to what Mr. Hangen claims.



VHB’s involvement in the BMIC project was first mooted by the Governor of the US State of Massachusetts, who was on a trade mission to Karnataka on 20th February 1995. On the same day, the Karnataka Government signed an MOU with VHB, SAB Engineering and Construction Inc., USA and Kalyani Group of India committing State support to the BMIC project as conceived by these companies. Subsequent statutory clearances have proceeded on the basis that all three companies as defined in the MOU are involved in the project.


Clearly, Mr. Hangen rejecting NICE’s claim that VHB is involved in the project indicates something gravely wrong somewhere.

Consider this. Without VHB, NICE is clearly not in a position to provide techno-economic support to this massive project. "By unquestioningly sustaining NICE’s claims, the Government of Karnataka has been party to this fraud of clearing the path for submission of project development capacity without basis. Over 25 key departments and agencies of the Government have reviewed the project over the past six years without examining parties involved. And now, VHB insists it has not been involved in the project since 1995 and that it has no plans for future involvement!", says Leo Saldanha.



It is a minor consolation that a fraud on the people of Karnataka has been uncovered. A fraud that has been actively perpetrated on the decision making process of the Government, and is clearly against the wider public interest.


What should shock concerned citizens everywhere is that the Karnataka Government has pushed through the project without reviewing any alternatives proposed, including the viable development of the existing two highways and minimum investment needed for doubling the rail-link between the two cities to enable safe mass transport systems. Further, on the advice of NICE, the Government has classified all details of the project, including techno-economic, environmental and social documentation, as confidential; a stand that has been upheld by the High Court of Karnataka.


Indeed, a public-infrastructure project, whose documents are not open to public scrutiny and debate.



Nonetheless, we assert that this is a democracy! But let's take a step back. Perhaps this is not a project for the many, using the resources of the many. A few lines about this project will help us understand why.



The BMIC project involves the building of an expressway between Bangalore and Mysore (about 130 kms). The cost of the BMIC project is Rs. 4,000 crores presently (US$ 1 billion, up from the previous costing of US$ 500 million, or Rs. 2,000 crores approx). Only around 7,000 acres of land is required for the Expressway, and yet around 21,000 acres is proposed for acquisition.

Why?



Tolls collected from the low traffic generated are not going to pay for the project. Well, step in, cross-subsidisation. About 7,000 acres of the land to be acquired belongs to the Government [i.e, the people of Karnataka], and this will be leased on to NICE at Rs. 10/acre per year, (i.e. 20 cents) as a subsidy.



Yes, rupees 10 per acre, in case you are shaking your head.


"There is huge government subsidization for the private land [about 14000 acres], which is being acquired from farmers. NICE will pay compensation to the farmers (after acquisition by the Government) at about Rs. 1 lakh (a lakh is one hundred thousand) per acre, and sell it in their townships at about Rs.5 crores (a crore is ten million) per acre", says Maj.Gen.S.G.Vombatkere, of the Mysore Lok Swaraj Andolana.



The primary purpose of the additional land is the development of five townships along the corridor including a Corporate Centre, Commercial Centre, Industrial Centre, Farming and Marketing Centre, Heritage Centre, Agricultural Centre and Eco-Tourism Centre. Income generated from exploiting the real estate so created would pay for the entire infrastructure. Whilst the Expressway will be returned to the Government in 30 years, the townships would be owned by the developers. The project promoters claim that the development of the townships will help in decongesting Bangalore.

What else? Two thirds of the land proposed for acquisition involve prime agricultural lands irrigated by a network of canals. A fair amount of forests and internationally recognised wetlands are going to be lost.

The most damning aspect of this project is that it will displace about two lakhs (200,000) people (information provided by NICE), of whom only about 20% will be entitled to compensation on the basis of landholding. The remaining 80% who are landless labourers, artisans and others dependent on agriculture-related activities, will not be compensated in any manner whatsoever.



The destination of these people, if you ask social scientists and peoples' groups who have documented generations of displaced people decade after decade, is not unknown. They will soon end up in urban slums. "Even some of the compensated farmers could join them in a few years, once the pittance of monetary compensation they get for their land is all spent.", says Vasu, of the Karnataka Vimochana Ranga, a grassroots liberation movement.


"Based on our analysis, it is clear that both the cost and the scale of displacement are being underplayed by NICE. What's worse, there is no land for land compensation provided for in this project", says Maj.Gen.S.G.Vombatkere, emphatically.



It is not known whether the human and ecological costs of this project have ever been properly audited by its promoters. 



Even if they have been, they have not been open to public scrutiny at the "hearings" conducted in mid 2000. Worse, the projected affected rural people have not been given Kannada versions of these documents, despite assurances given by government officials in March 2000. Instead, strong use of force has been targeted against citizens’ groups, and State initiated human rights abuses have been the norm during Statutory Public Hearings held last year. Some hope emerged when on July 14, 2000, the National Human Rights Comission (NHRC) accepted a petition from Leo Saldanha, one of the persons assaulted by Police at the Bangalore hearing in July 5, 2000, in full view of the public and the media. In their response to the complaint which they filed with the Commission in November 2000, the Karnataka Police deny the charges of human rights violations and instead accuse all those who were assaulted and arrested of being guilty of unlawful assembly and obstructing proceedings. It is not clear how the public hearing could proceed meaningfully without important project related documents [numbering more than ten], and futhermore, how an alert public gathered to scrutinize the project are an unlawful assembly! Curiously, a copy of the Police response was sent to the petitioner for his comments only in March 2001, four months after the Police filed their response. As of April 2001, the NHRC still has the case file open.



In the meantime, on April 26, the Union Public Works Minister, Dharam Singh issued press statements saying that "the Government had submitted detailed proposals to the Union Ministry of Environment and Forests concerning resettlement and rehabilitation, clearing all major hurdles for the project." Commenting on the meeting of the high-level advisory committee of the MEF on April 27, to consider the proposal for environmental clearance to the BMIC project, the minister said that "the committee is likely to give clearance for the project".


Like cars on a north american freeway, the ironies have continued to flow. At about the same time the "hearings" were "held" the Government of Karnataka was holding a series of consultations with academics, trade unions, journalists, legislators and NGOs on legislating a Right to Information Act. Perhaps this "right" did not apply to those who were excercising their democratic right to information regarding the BMIC project.



A note on the official word, on whom this project is for. The Karnataka Chief Minister S.M. Krishna recently stated that the BMIC expressway is for those who can afford the toll. There's no official word on why government officials across a plurality of functions have callously set aside the fact that the real price is being paid by thousands of common people in the rural areas ranging from suburban Bangalore to Mysore, as well as the ecology. On the other hand, the possibility of informed public opinion influencing decison-making through scrutiny and debate [a.k.a democracy], was brushed aside in the public "hearings" of 2000.



Perhaps, for those who couldn't afford the toll, or live in the lavish townships that would be developed, there is always the old road and congested cities. In fact the expressway and townships proposed are planned to be walled all along to provide safe passage and enclaves for those who can afford!



Let's get back to the most recent development. So, with the lead engineering member of the BMIC consortium saying that they were never part of it and do not see any role for themselves in the future, what has been opposed from the beginning as a classic case where the well-off are being subsidised by the voiceless, now seems to have regressed to take on another dimension.

Fraud.



Clearly, there is a warning here that must be heeded. Reckless infrastructure "development" in the absence of clean, transparent and just governance, will continue to result in the abuse of State machinery and appropriation of people's resources for the benefit for the few, at the cost of the many. What else can this foist on the people, one wonders, but case after case of touted cure being worse than the disease?

And yet, the situation is not beyond redemption. The Karnataka Vimochana Ranga (KVR) is organizing a mobilization of the affected farmers and landless laborers starting May 1, and culminating in a rally at Mandya, near Mysore, on May 10, 2001. Their opposition is bound to increase only further with the latest revelation.

Finally, what can concerned citizens of Karnataka and non-residents do?



Excercise your democratic right to pressure the authorities. Write [and encourage your friends to] letters, emails and faxes. Urge that all clearances given to the BMIC project be revoked, the Government of Karnataka stop the ongoing process of land acquisition, and the Ministry of Environment and Forests which has been considering the project for final environmental clearance, reject the same. Finally, request that an investigation into this matter be initiated immediately.
